The judicial documentation of Southern Medieval Italy since the 9th century and before the establishment of the Reign of Sicily has had an evident role in the context of written production. In a moment of large spread conflict, in urban areas and on the outskits, the courts of justice would reunite and organize themselves according to legal contexts and local habits. In particular, the "notitiae iudicati" produced in Longobard areas represent an important sorce in order to familianze with the administration of justice until the second half of the 11th century. The "notitiae iudicati" model survives in a Norman age with ragards to the document structure and to the "iter" proceedings and also to people who made up the court of justice.
The research involves the following objectives:
1) to define the characteristics and the types of jidicial documents of Swabian age, produced above all in the Campania region which was already Longobard in order to assure persistances and transformations in respect to tghe older models;
2) to compare these documents with those produced in other geografical areas in order to verify the surmounting of local differences that corisponds to a political cantralization;
3)to comprehend how in different contexts the laws of Frederique the second habe been applied in regard to the administration of justice. Also to understand which level of corrispondence between the doctrine and practice habe been met.

I documenti dei mercanti nel quadro socio-economice del medioevo

I documenti dei mercanti, notarili o meno, costituiscono un patrimonio ricco, complesso e interessante di cui si sono occupati quasi esclusivamente gli storici dell’economia e del diritto. Solo da qualche anno, un rinnovato interesse e una diversa lettura di questo materiale suggerisce una linea di ricerca alternativa per dimostrare come un suo studio da parte della diplomatica e un suo trattamento diplomatistico, ancora tutti da fare, siano in realtà possibili e in prospettiva stimolanti.
Questo contributo costituisce, quindi, un primo tentativo in questa direzione e ha lo scopo di considerare il documento del mercante sia in se stesso e nella sua peculiare autonomia, sia in rapporto alle diverse funzioni che esso svolge e alle diverse forme che esso assume, sia in relazione al sistema generale di documentazione all’interno del quale viene prodotto.

From the Lucchese notary Ciabattus (ca. 1204-1277) are more than 30 registers with more than 7200 pages extant. This fact allows us to see quite clearly for whom, how often and how much he worked.

Les testaments dand la société médiévale portugaise (XIIe - XIVe siècles)

L’accroissement exponentiel du passage à écrit des actes juridiques constitue un fait bien connu dans l’Occident européen à partir du XIIe siècle, ainsi que leur importance de plus en plus significative dans la vie des hommes du Moyen Âge. Parmi les documents qui envahissent leur quotidien se trouvent les testaments, dont le nombre augmente surtout depuis le XIIIe siècle, accompagnant la croyance au purgatoire et à l’efficacité des suffrages pour obtenir le salut dans l’au-delà.
Les testaments se répandent et acquièrent rapidement des caractéristiques spécifiques; en tant qu’actes privés destinés à être connus et exécutés après la disparition de leurs auteurs, il fallait assurer leur authenticité et que les dernières volontés des testateurs seraient respectées, même quand ils n’avaient pas l’occasion d’en faire des instruments publics.
Cette communication a pour but l’étude de l’ensemble des testaments produits par les chanoines et les évêques des cathédrales portugaises du XIIe au XIVe siècle, en voie de publication comme résultat du projet de recherche “Fasti Ecclesiae Portugaliae”. Elle porte sur l’univers des testateurs, l’évolution de ce type documentaire au long des siècles en question, les conditions dans lesquelles les testaments étaient rédigés et les différents états où ils sont parvenus à nos jours (brouillons, minutes, originaux, copies simples ou authentiques), ainsi que sur les procès de validation et les mécanismes par lesquels ils étaient publiés et exécutés après la mort des testateurs.
